In addition to State action, the United States Congress has introduced a variety of bills regarding the protection of personal privacy online, most recently HR-5777 (Introduced July 19, 2010) : “Building Effective Strategies to Promote Responsibility Accountability Choice Transparency Innovation Consumer Expectations and Safeguards" Act. Outside the U.S., the European Union required encryption of personal data as early as 1998.

Under the more proactive laws, businesses must encrypt personal information transferred by electronic transmission, other than a facsimile, outside the secure system of the business. Implementing all reasonable means to protect this information is required.
